Upon completion of a custom website design and full payment of web design and development fees, the client is the owner of the commissioned website. The client may continue to use the commissioned website to promote the client’s company or organization regardless of whether he/she chooses to continue further services with DK Small Business Solutions, LLC. The client does not have the right to resell the design or development to other companies. The client does have the right to add pages onto the existing site or have another company add pages onto the existing site using the commissioned website design/development. The client does not have permission to reuse pieces of our work in a redesigned website that gives another company design credit. Client is responsible for all debt owed for their services from DK Small Business Solutions.

All Web Design Agreements last for 30 days from the signing date of the agreement. Any revisions or modifications will incur additional cost. Only work that will be conducted at the agreed quote price will be done within the Web Agreement. Anything additional that was not quoted or agreed upon from the initial start of the agreement will be an additional cost. No additional work will be performed until payment for services outside of the agreement have been paid in full.

• Minimum 1 hour billed for any work done by the hour ($35).
• Most work will be completed within 3 business days of your confirmation updates. Client must confirm satisfactory of updates within 3 days of completion. If no communication is made within those 3 days, updates are considered satisfactory or no longer required. Any updates after the 3 days of non-communication will result in billing fee starting at $35.
• There will be no “piece mealing” of work. All update requests must be ready with content, forms, images, etc. ready to execute on the day of request. All images need to be sent as an attachment via email to [email protected].
• Client must provide site, page and section/location of updates for each request.
• Maintenance does not include fixing malware or hacking issues. DKSBS will assist those who have purchased Cyber Security Software through DKSBS.

All web hosting accounts through DK Small Business Solutions, LLC with unpaid balances for 30 days will be deactivated. A late fee of $10 is due after 14 days of due date. Late payments after 30 days will result in the account being deactivated with a reactivation fee of $25. Web hosting accounts with unresolved balances after 60 days will be deleted by DK Small Business Solutions, LLC.

The deletion of your web hosting account will delete your website as well and will need to be re-created unless web hosting services are paid prior to the 60 days deadline.

All accounts/websites will be deleted after 60 days of inactive payments for web design services and/or hosting services. There is a $25 reactivation fee for all accounts.

Website domain names are leased from domain name registration companies. When DK Small Business Solutions, LLC registers a domain name for a client, that registration will be made in the client’s name. Upon payment of any outstanding fees, the client has the right to use that domain name regardless of whether he/she chooses to continue further services with DK Small Business Solutions, LLC. Domain name renewal and renewal fees are the responsibility of the client. If the client chooses to have DK Small Business Solutions, LLC renew the domain name on behalf of the client, an additional service fee will apply. Clients are advised to closely monitor the renewal date of a registered domain name and to verify that the renewal of said domain name has been completed. DK Small Business Solutions, LLC cannot be responsible for expired domain names.

All text and photos used as content in a commissioned website must be provided by the client (unless the client has hired DK Small Business Solutions, LLC for content development). The client must have ownership or written permission to use all content he/she provides for use. It is up to each client to ensure his/her design and/or content does not infringe on any trademark, service mark, or copyright. DK Small Business Solutions, LLC cannot be responsible for intellectual property infringements on behalf of clients. Also, DK Small Business Solutions, LLC cannot be responsible for submitted content. Clients should not mail irreplaceable photos or documents or send content that must be returned.

All content must be submitted electronically via email (submit to [email protected]). Text must be selectable as actual text rather than as flattened images. Both text and photos/graphics must be clearly labeled with the name of the page on which they will be displayed. Content may not be submitted via fax or paper copies. Exceptions to this policy must be approved in advance and may incur a surcharge.

All images submitted must be in jpg or png formats.

DK Small Business Solutions, LLC clients are also required to use secure passwords on all logins. A secure password should include a minimum of 12 (twelve) characters, include a mixture of uppercase letters, lowercase letters, numbers, and symbols, and should avoid commonly guessed or hacked elements. DK Small Business Solutions, LLC is not responsible nor will be held liable for any security issues on your website.

DK Small Business Solutions, LLC offers cyber security services for all websites created under DK Small Business Solutions, LLC platform. If a client declines cyber security, DK Small Business Solutions, LLC is not responsible for websites that have been hacked. DK Small Business Solutions, LLC charges a fee for restoring hacked sites. If the client fails to secure their site, DK Small Business Solutions, LLC is not responsible.

Third party vendors may have separate terms of service agreements. DK Small Business Solutions, LLC cannot be held liable for disputes with third party vendors, regardless of whether the service is part of a reseller agreement or referral. DK Small Business Solutions, LLC cannot be held responsible for lack of functionality or any other aspect of third party services.

Search engine optimization services included in project is just the first step in search engine optimization and is a one-time service. Most every client would like his/her website to rank high in search engine results for selected keywords, yet search engine results are determined by a multitude of constantly changing factors, third party search engines, and the amount and quality of competition on the world wide web. DK Small Business Solutions, LLC uses search engine‐friendly techniques that may include keywords in the title bar, the meta tags in the hidden coding behind the scenes, and alternate image. Subsequent or additional changes will be billed at the standard hourly rate. Additional search engine optimization (SEO) services are available for additional fees. DK Small Business Solutions, LLC cannot be held responsible for search engine results.

All revisions or contract scope changes must be submitted by email or text message, and may be subject to an additional fee at the standard hourly rate.

All reoccurring services provided will be auto payed by the terms of agreement by the initial method of payment. Client can request to change method of payment at any time. For missed/late payments, please see Late Fees section.

If a billing error is noticed, the client should immediately contact DK Small Business Solutions, LLC. Refunds of overpayments will be made for up to a maximum of three months, so clients are urged to check billing statements regularly. Refunds of more than three months will not be processed. Additionally, DK Small Business Solutions, LLC reserves the right to bill clients for accidental undercharges for a maximum of up to three months.

We take pride in offering high quality services and professional customer service. While we make an effort to ensure every aspect of our service is to the client’s liking, we cannot control every variable. It is up to each client to regularly test the functionality of his/her website, email, and any other product or service to ensure everything works as desired. If any problem is discovered or error has been made, please report the problem to us immediately so we may take appropriate action. We cannot be responsible for perceived loss of revenue under any circumstances. Changes resulting from a client’s error and/or problems related to third party vendors or technology, such as hosting servers or browser software may result in additional charges.

If the client changes his/her mind about doing work with DK Small Business Solutions, LLC during the initial web design or development phase, the client will be responsible for the amount of work already completed. Depending on the amount of work completed at the time of cancellation, this may mean receiving a full refund, a partial refund, no refund, or owing additional fees. See the refund policy in the next section for additional information.

DK Small Business Solutions, LLC reserves the right to refuse or discontinue service to anyone for any reason, or for no reason, at any time.

Domains registered with DK Small Business Solutions, LLC may be renewed at any time prior to expiration for a maximum period of up to 10 years. While we will often call and/or email you prior to domain expiration, we do not guarantee we will do so and it is your responsibility to keep track of your domains expiration date. Domains expired for more than 30 days may result in loss of domain or additional charges to get the domain back.

Domain renewals will be automatically renewed and billed based on selected renewal terms. Registrant needs to contact DK Small Business Solutions if they would like to terminate auto billing.

The failure by a customer to meet or follow any of the above Terms of Use is grounds for account deactivation. DK Small Business Solutions, LLC will be the sole arbiter as to what constitutes a violation of the Terms of Use. DK Small Business Solutions, LLC reserves the right to remove any account without prior notice. Depending on the severity of the violation, DK Small Business Solutions, LLC may, at its sole discretion, restrict, suspend, or terminate a customer’s web hosting account and/or pursue other civil remedies. If such violation is a criminal offense, DK Small Business Solutions, LLC will notify the appropriate law enforcement authorities of such violation. DK Small Business Solutions, LLC does not issue credits for outages incurred through service disablement resulting from Terms of Use violations.
